Eventyno Terms of Service

1. Acceptance of these Terms
By creating an account, accessing, or using Eventyno (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms as described in Section 20 ("Changes to these Terms").
2. Eligibility and account requirement
You must be at least 13 years old to create an Eventyno account. By creating an account, you represent that you meet this requirement, that the information you provide — including your birthdate — is accurate, and that your use of the Service complies with all applicable laws.
Accounts for users 13–17 ("teen accounts"). A small set of capabilities are off by default for a teen account and require an active, approved relationship with a parent or legal guardian to turn on: publishing an event with "Public" visibility, and the public-exposure profile settings (public profile, publicly showing attended/upcoming events). A teen account can always use the Service, including creating and sharing events with "Anyone with the link" visibility, without a guardian relationship. See our [Guardian Consent for Teen Accounts](/guardian-consent) document for the full terms of that relationship, including how a guardian or teen can end it at any time, and Section 14 below.
No independent accounts under 13. Eventyno does not offer independent accounts to anyone under 13. A parent or guardian may instead list a child under 13 as a "dependent" on their own account, for identification purposes only (for example, naming a child as an event's honoree) — this never creates a login or any account the child controls. See Section 14.
At signup you will be asked to confirm your birthdate and to check: "I confirm that I am at least 13 years old and agree to the Terms of Service and Privacy Policy." We record which version of these Terms and the Privacy Policy you accepted and when. A signup that reports a birthdate under 13 is rejected outright, server-side, regardless of what the sign-up form itself does or does not check — the sign-up form is not the only possible way to reach account creation.
2b. What's new in this version
This version lowers the general minimum account age from 18 to 13, introduces the teen-account and guardian-consent model summarized above and detailed in Section 14, and describes the event-subject (event honoree) photo-authorization model referenced in Section 5.4. No other provision of these Terms changed. As with every prior version, using the Service after this update takes effect constitutes acceptance of it; viewing a public event page never requires any separate acknowledgment.
3. Your account and account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at [LEGAL EMAIL] if you suspect unauthorized access to your account.
You may not share your account, impersonate another person or entity, or create an account using false information.
4. Acceptable use
You agree not to use the Service to:
including any form of child sexual abuse material — this will be reported to the appropriate authorities as required by law;
manner;
authorization (for example, government ID numbers, financial account details, or precise home address in a way intended to enable harm);
of identifiable individuals without having the rights or permissions necessary to do so;
that are not yours, or interfere with the security or normal operation of the Service;
- violate any applicable law or regulation;
- upload, post, or share content that is sexually exploitative of a minor,
- share non-consensual intimate imagery of any person;
- make credible threats of violence or harm against any person;
- harass, stalk, or target another person or group;
- impersonate another person, business, or organization in a deceptive
- distribute malware, phishing content, or engage in fraud;
- unlawfully discriminate against any individual or group;
- infringe the intellectual property rights of others;
- share another person's highly sensitive personal information without
- violate the privacy of any person, including by uploading photos or videos
- attempt to circumvent event privacy settings, access accounts or events
- engage in any transaction prohibited by these Terms (see Section 9).
We may also publish separate Community Guidelines that provide more detail; they are incorporated into these Terms by reference.
5. Content you create and share ("User Content")
"User Content" means the photographs, videos, written stories, event details, gift-list content, and other material you upload, post, or otherwise make available through the Service.
5.1 You own your content. As between you and Eventyno, you retain all ownership rights you have in your User Content. Eventyno does not claim ownership of your User Content.
5.2 License you grant us. To operate the Service, you grant Eventyno a limited, worldwide, non-exclusive, royalty-free license to host, store, resize, process, transmit, reproduce, display, and distribute your User Content solely as reasonably necessary to operate, maintain, secure, improve, and provide the Service to you and to the guests you choose to share your event with (for example, generating thumbnails, creating link previews, and delivering your event page to your invited guests). This license ends when you delete the applicable content or your account, except to the extent copies reasonably persist in backups for a limited period, or as needed to comply with law or resolve disputes (see also Section 15, "Data retention," and the Privacy Policy).
5.3 Your warranties. By uploading User Content, you represent that:
it and to grant the license in Section 5.2, including the consent of any identifiable person shown in a photo or video, and, where the content includes a minor, the authorization of that minor's parent or legal guardian;
intellectual property, privacy, publicity, or other rights;

5.4 Photos and videos of minors. Eventyno is intended for family events and similar occasions where photos or videos of minors may appear (for example, a family celebration). By uploading such content you represent that you have the necessary rights and authorization from a parent or legal guardian to do so. See Section 14 ("Children and minors") for more detail.
6. Intellectual property
6.1 Eventyno's IP. The Eventyno name, logo, brand, source code, design system, and other proprietary materials are owned by Twilight Media Design Corp. and protected by intellectual property laws. Except for the limited right to use the Service as intended, these Terms do not grant you any right, title, or interest in Eventyno's intellectual property.
6.2 Third-party and open-source components. The Service may include third-party and open-source software components, which remain subject to their own licenses. See NOTICE.md in the Eventyno repository for a list of significant third-party dependencies and licenses.
6.3 Copyright complaints. See our Copyright Policy (linked at `/copyright`) for how to submit a copyright infringement notice or counter-notice.
7. Content moderation, removal, and account actions
We may review, remove, or disable access to content that we reasonably believe violates these Terms, our Community Guidelines, or applicable law, and we may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or create risk or legal exposure for Eventyno or others. Where reasonably possible, we will attempt to notify affected users, but we are not obligated to do so, particularly where notice could interfere with safety, legal, or moderation processes.
You can report content you believe violates these Terms using the "Report" option available on public event pages, or by contacting us at [LEGAL EMAIL].
8. Third-party links and services
Event pages may include links to third-party websites, including gift/product links you add to your Gift List. Eventyno does not control, endorse, or take responsibility for third-party websites, their content, their merchants, or their business practices.
Purchases made on external websites are handled by those third-party merchants and are subject to their own terms. Eventyno does not guarantee the price, availability, shipping, fulfillment, item condition, or safety of any product or merchant linked from an Eventyno event page, and is not a party to any transaction between you and a third-party merchant.
9. Payments (future feature; not active in this phase)
Eventyno is currently free to use, and account creation does not require payment information. If we introduce paid plans, premium events, vendor accounts, or other paid features in the future, additional terms covering pricing, billing, automatic renewal, cancellation, and refunds will apply and will be presented to you before you are charged.

Eventyno never stores your full payment card information; that data is handled directly by our payment processor (planned: Stripe).
10. Service availability and modifications
We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWILIGHT MEDIA DESIGN CORP. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW.
13. Indemnification
[ATTORNEY REVIEW REQUIRED.] To the extent permitted by applicable law, you agree to indemnify and hold harmless Twilight Media Design Corp. from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.
14. Children and minors
Account creation requires you to be at least 13 years old, confirmed by a real birthdate at signup (Section 2). Eventyno does not knowingly create independent accounts for anyone under 13.
Teen accounts (13–17). A user aged 13–17 has a real, independently usable account, with a defined set of capabilities gated behind an active, approved relationship with a parent or legal guardian: publishing an event with "Public" visibility, and the three public-exposure profile settings. A teen account cannot turn these on by itself; only an active guardian relationship's controls (or an administrator) can. The full terms of that relationship — what it covers, what is collected, and how either party ends it — are in our separate [Guardian Consent for Teen Accounts](/guardian-consent) document, which a guardian must review and agree to before the relationship becomes active.
Under 13. Eventyno does not offer any independent account, login, or public profile to anyone under 13. A parent or guardian may list a child under 13 as a "dependent" on their own account solely for identification purposes (for example, naming a child as an event's honoree); this never creates an account the child controls.
Event subjects and family-event media. An event may name a "subject" — the person the event honors (a birthday child, for example) — separately from the event's creator. A subject's optional photo defaults to hidden on both the event page and any printed invitation, and is shown only if the event's creator explicitly turns that on. Family-event media (any photo or video that includes a minor, whether as an event subject or otherwise) may be uploaded only by users who have the necessary rights and parental/ guardian authorization to do so, as described further in Section 5.4 and in our Privacy Policy.
If you are a parent or guardian and believe a minor's image has been uploaded without proper authorization, or you have another child-safety concern, please use the "Report" feature on the event page or contact us at [LEGAL EMAIL]. Reports involving potential child exploitation or abuse are treated as urgent.
15. Suspension, termination, and account deletion
We may suspend or terminate your account for violations of these Terms, as described in Section 7. You may delete your own account at any time from Account Settings ("Delete My Account"). See our Privacy Policy for how account deletion affects your data and content.
16. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent applicable law requires the laws of your jurisdiction of residence to apply.

Any such clause must be drafted and reviewed by qualified counsel, including review of jurisdictions where such waivers are unenforceable or restricted, before being added to these Terms.]
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be interpreted to best reflect the parties' original intent.
18. Third-party beneficiaries
These Terms do not create any third-party beneficiary rights, except as expressly stated.
19. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
20. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and version identifier, and, where required by law or where changes are material, provide additional notice (for example, by email or in-product notice) and may request renewed acceptance, which we will record with its version and timestamp as described in Section 2.
